My maid finally sign the resign letter for me on 12 April that her last working date will be 11 May. She work for me from 11 Feb 2007 (15 mths) and the date of departure is 9 Feb 2007. I want to know how many yearly vacation dates she can gain (8.75 days or I need to pay her 9 days?) If I let her go earlier by deduct the holidays, let said 9 days, what's the last date? should it include sunday?
And about the levy, if the starting date count from 9 Feb or 11 Feb ? Thanks again for your kind help !

You should pay her 9 days instead of 8.75 days. During the one month notice cannot deducted by annual leave. Levy started to count on arrival date Feb 09.

因我剛剛請了工人, 在香港做了14個月, 4/23 visa到期, 原本說可以返 china 等visa, 但是今天通知我唔可 ...

我無收倒風話唔可以，邊個話你知稼? 咁佢又無話去Macau得唔得呀?

1. Yes, 領事館蓋印合約+Old contract + your maid original passport + Immigration所有Forms+you & your maid HKID copy+ income proof copy + original/copy address proof.

想請問,我的工人姐姐菲已在我家至今年9月底,將完第三張約,她一真表現都o.k..照顧囡囡都唔錯,又因囡囡今年9升小一唔想她內太多的轉變所以都想同她續第四約,但同她傾時,她有以下的要求:

1.例假要11:00p.m回家,佢話法例她可以有24小時休息,所以想遲d回家。(平時我們要求她9:00回家,但近年時遲了至10pm)

2.如連續兩天假期,她要求要在外面過夜唔返來睡,當然我個人就接受唔到,但實這是否是他們的權利,而我打電話到勞工處問,他們說沒有法列規定她們放假要在家過夜,只是要求在24小時後能如上班就可以,

所以想問她的要求是否合理,如我給她在外住宿,在保險或法列上我又要有什麼責任要負?

LET HER GO!! 佢唔同你續約，你就唔駛俾佢長期服務金。

我就唔會同意以上各項要求，你同佢講放假前一晚或當晚訓覺時間都計架，24小時佢由幾點開始計呀! 另外入境處在合約上清楚列明 "住" 及做工都只可在合約地址，即不可外宿。同佢講你唔會同意佢既要求，叫佢答你續唔續約，佢say no就唔駛俾佢長期服務金佢，所以你千其唔好主動話唔同佢續呀!

先renew passport再攪renew contract. 所有費用由僱主支付。

如她真的唔續約的話.咁使唔使要求她白紙黑字寫下是她不想續約?之後先話比聽她唔會有長期服務金,咁佢會好冇引...
另如果佢話續約時,但又好似不甘心咁,咁點算好?

I received a call from Immgration Dept. today informed me that the visa is ready. She asked me to inform the agent to collect the visa. May I know once I inform the agent, when the maid can start work for me? I didn't inform the or ask the agent directly because I want to have a better time management as I am having a part time helper working for me now.

Standard is within 2 weeks.

You can also request to the agent the date you prefer for the maid to arrive in Hong Kong. Do note that once the visa is release it is valid for the maid to arrive in Hong Kong for within 3 months.

IS this the Labour rule to give the maid "Meal and travelling" when she finished contract and back home ? How much for the allowance per day ? Do I have to pay her the allowance even she live in Jarakta and I have bought her ticket to Jarakata already ?

My maid will leave my home on 30 Apr. How much I have to pay for finished contract ?

1. Apr's salary (1 month)
2. 14 days unused annual leave
3. Air ticket
4. Meal and travelling allowance (must ???)

Since my maid is finished contract, do I have to pay the salary upto May 14 (include Apr salary + 2 weeks unused annual leave) or just pay till Apr 30 ?

1. 係可以一年內先出境，你可以比返菲律賓機票錢佢。

2. 佢可以自行向immigration dept 申請轉僱主。不會即日銜接，申請需時約一個月。合約費$297.50 + Visa費$160。 ...

印印識做renew contract ?

Dear Mrs. Rose
I need to renew the 印印's contract and planned to ask
the agent to process. They charged me for $2800 and I
planned to pay by myself .
Then, my bunbun (another maid in my family) said that 印印 could also renew the contract by themselves and tried to save my money.

Is it really very complicate to renew 印印's contrct my
ourselves. My friend's maid did that before but she left
already.

Where I can learn more about the details and procedures?

我之前曾經提問以下問題, 由於問題太多, 你說會致電回覆, 我亦PM我旳電話號碼給你, 但我上星期去了日本, 不知你有否打電話給我, 所以現在再重提舊問題, 煩請你幫忙

我剛與印印續約, 她不會回印尼,

1) 我是否一定要用錢代替14日有薪假? 可否4年約滿時提早給她走

2) 她說完約就算不回印尼, 我都要比機票錢給她, 我都知道需要, 而且為免她對我個B唔好, 我一定會做, 但要比單程或是雙程?

3) 現在她只有一年working visa, 佢需要出境後才可以取多一年working visa, 我是否要到Immigration Dept辨理? 而且佢出境果日是否可要求用她的weekly holiday?

4) 由於我會比機票錢佢, 佢出境的費用, 是不是她自付? 佢出境時, 我需唔需要寫信証明佢會回港?

5) 佢個印尼passport年尾就到期, 是否需要她親身做? agent 可否代辨? D費用有是誰付? 是否可要求用她的weekly holiday?

6) 佢應該換passport先定出境先呢?

Mrs. Rose:

I have just renewed my contract with my Filipino maid. She does not want to go back to the Philippines this time, which is good given that i am about to give birth. Thus, I have the following questions

(1) For the airplane ticket that we owed her (round trip - flight back for the first contract and the flight in for the 2nd contract), do I pay her in cash? about how much?

(2) For the 2 weeks holidays that we owed her for the first contract, do I just carry that over to the next contract, or do I pay her in cash instead?

(3) I believe that she has to leave HK within this year (as the visa will be only a year) and then re-enter. If I go with her to China around x'mas, will they restamp the visa until the expiration of the 2nd contract?

I cannot type Chinese on this computer. Sorry!

係一定要她白紙黑字寫下是她不想續約，叫佢連原因都寫埋，因僱主唔批準佢出外過夜及放假後要求晚上11時返家。

至於她唔會有長期服務金呢一點，不需同佢特別講，你受法例保障依法辦事。

如果佢話續約時，好似唔甘心，唔該你 '飛' 左佢啦...

一般會係Boarding House住到visa出至開工。未有工作證(visa)就開工即屬違法!

請注意現行法例只有工人完約、僱主移民、僱主過身或僱主有財政問題先可在港轉工，其餘一律要離境重新申請。

Hello Mrs Rose,
My filipino has been working fr me fr 3
years now and taking care of 2 young
children. Last night she told me she
received a SMS fm her auntie that her
uncle has passed away and she need to
go home to bury him. She will advance
the paid leave + plane ticket fm the end of this contract and she's also asking me
to advance some salary to her. I hv
the following questions :
a) according to the law she is entitled to
21 days of paid leave. does sunday counts ?
b) What documents do i need her to sign
better she leaves ?
c) Do i need to inform the immigration
that she's taking leave early ?
