I hire my helper just 5 days, the aim to take care my father, but outcome my father don't like have a stranger in home, so we decided to terminate my helper since I know not my helper fault.

So I want to know,
1) if I want to terminate the maid at 12 May 07, Does I just notice her at that day is ok, and tidy up the luggage at once? no need prior notice her and agency?

ANS:{No need prior notification, but why not tell your Agent and asked them give you some advice and also help you to prepare all the neccessary documents for the termination?}

2) Of course I know I need to paid her 1 month salary compensation instead to 1 month notice, + return air ticket (how much) and this two weeks salary, 100 travelling expenses, and anymore?

ANS:{Correct & no more others, about the ticket for Manila/Jakarta around $1300 & Surabaya $1900, you can check with the Travel Agents}

3) Does I need to inform agency prior, and give the above compensation to maid facing in agency office?

ANS:{Up to you, its better that you inform your Agent in advance, they should provided you with these services}

4) And should I need to writing a letter to inform immgaration refer the maid stop the contract with me, or inform by agency?

ANS:{You should write a termination letter to HK Immigration informing them your maid had already left your house. Pls note, this letter should be submitted within 7 days from the released date}

We wanna hire a local Phillipine DH who will finish her contract in the near future. However, some agency told me that it is very very risky to hire these DH . It is because most local Phillipine DH is very cunning and difficult for me to handle their problems.

Is it true?

Is oversea better than local?

For hiring a local Phillipine DH, what should I pay attention. Or is an oversea DH suitable for us?

Ans:{I disagree, there are also many good local Philippines DH too. However, they maybe picky in choosing their new employer and having concerns like the off days, employer family members, pets, having own room etc

As the local DH had already accustomed to HK environment, she maybe able to work indepently quickly in your family which is what your present situation requirments.

A few things to note hiring local DH:

1) Let her know about your family members especially to mention about your 99 staying with you.

2) She may want to go back to Philippines for her holiday before starting in your family.

3) If there are any house rules in your family, its better to tell her clearly before any commitment to take up your job.

Question:
1. How to calculate the final salary, including the annual leave? As her plan annual leave is in between her old and new contract.

2. Can I make a clear cut off on 22nd June 2007, i.e. she take 4 days actual annual leave from 17th June 2007 to 22nd June 2007 and treat 23rd June 07 & 25th June 2007 to 30th June 2007, totally 10 days, as her no pay leave in new contract? (of course, she will receive 10 days annual leave allowance for these day instead).

3. Alternatively, I pay her 14 days annual leave allowance plus the rest day and public holiday (19th June 2007) and agree with her that the date of services report should be 1st July 07(although the new contract date is started from 23rd June 2007).

ANS:{Very easy, you give her the salary until last working day, ie. June 17. +14 days Annual leave+ 2days Labour holiday on 19/6 & 1/7 by cash. You start to caculate her salary when she back to HK on 1/7. No need to think so many with pay without pay new contract old contract!!}

1. Is there an option to renew contract for 1 year only?

ANS:{NO, by Law must be 2 years in one contract}

2. Do I need to pay agent fee for the 1-year renewal?

ANS:{You need to pay for the renewal,usually agent charge you is per case not per year.}

If I need to pay the agent fee this time, then I will tend to not renew the contract with her, because I do not want to pay another agent fee after 1 year. I will tend to hire another maid, since the existing one is not that good after all.

I would like to ask if my maid gave me resignation letter on May 8. She mentioned in the heading saying that "Break Contract #xxxxxx" and put a date "05-08-07". In the content, she also mentioned that "decide this day to break my contract just because ....".

Does she need to give me $3,320 as the one month notice payment? If yes, can I offset the amt with the outstanding salary that i suppose to give her.

ANS:{Yes, if she leave your house now you can ask her to pay you one month notice in lieu by cash. But may be this is her one month notice to you, pls clarify with her first}
