Dear Mrs Rose,

I have a problem. Hope you could give me advice.

I would like to employ a Philippine maid who are now employed by another employer currently. Due to some reasons (the employer dislikes this maid), the current employer gives this maid one month notice and ternminates her contract. It is good for me, as I want her to help me as early as possible.

But the problem is, when I submit the doc to the consulate, they ask me to submit ID522 as well. It seems that this form should only be issued by the immigration for 4 specified reasons. Immigration said that the maid needs to return to her original place and then submit the document again.

For me, I actually don't want she leaves HK because of my urgency. Do u think there is any exceptional case that this maid no need to go back her home place and stay in HK to start my contract? Please advise.

6. 因出機票時是要一同付tax的, 佢退票時連同我的tax一同退回, 我如何可以取回?
ANS:{唔會退返tax俾你架}

7. 如出機票給她, 她拿去退票, 扣除手續費她可能只拿得$1,100 所以agent說, 跟她商量可否discount給她, 即不用比$1,600這麼多, 但要她簽收就寫是收$1,600 請問這是合法嗎? 有沒有手尾跟?
ANS:{唔駛聽你Agent講咁多，一係俾$1600現金，一係就俾機票，樣樣根據法例就唔會有手尾跟}

8. 她現在去另外一間agency找請僱主, 佢話佢個間agency要我們的合約正本, 請問這是否正常程序?
ANS:{係要既，但工人自己應有一份正本合約}

9. 請問有沒有一個step list(如要她簽收什麼收據 & 提交什麼文件給immigration等等), 請問有沒有format, 請pm給我或e-mail: [email protected]

你睇清楚我有答喎，我話要搵間可靠既Agent係好重要既，而你講果D咪係無良Agent囉。每行業都會有"無良一族" Agent唔係個個無良，專業守規既Agent亦大有人在。而我都無收過你錢，米一樣同你傾計。

No exception will be given by the HK Immigration. However, since the terminated maid have to depart HK to wait for her visa approval, you can put her up in Macau instead. That will avoid the processes needed to be taken in Philippines and cut short you waiting period.

Hello mrsrose,

舊工人做了約2年10個月

我7月30日比一個月通知解僱菲傭, 簽訂termination letter, 內裡寫明one month notice, last day 係8月30日, 有証人簽署

8月30日舊工人已簽收工資, 年假薪酬, 機票(已付department tax), $100 transport, 有証人簽署

問題1.
咁我係唔係可以炒個菲傭架？要不要賠1個月工資?要比代通知金嗎?

問題2.
佢e+要求我比遣散費, 勞工處約我上去, 我係唔係要比舊工人遣散費?

問題3.

炒左舊工人之後, 我現在家裡已聘請有新菲傭, 咁算唔算裁員? 我還要比舊工人遣散費嗎?

You just pay her the reasonable price, if she not agreed just give her the air ticket. By Law of course you need to pay her airport tax & levy etc....

No need to exam if she worked in HK more than 2 years before. By HK Law all the processing expense including Philippines side should pay by the employer.

14日大假錢當然要俾返工人，至於机票就同佢講唔會折現，想要机票既話就返印尼放假，到時會俾佢。

我想請返舊工人，佢問返agent攞passport，agent話僱主keep左，想問：

1. 工人被agent或僱主keep住passport唔比返佢，可否報警？

2. 如工人唔見左passport，佢同我可否簽contract？可否報失去補領，定係要返印尼先？

Extend Contract

Dear Mrs Rosa,

My maid's contract will be expired on Dec 07. Since she will get married on next Jun 08 and she will not work after get married. I want to extend her contract until Jun 08. Can I do like it? Is it troublesome? Can you please tell me the detail of procedure how to apply the contract entend in both HK & Phi. government?

香港法例唔可以收工人任可手續或介紹費，只可收僱主。所以本地完約工人服務費係會比請海外既貴。

By law renew contract must be 2 years cannot only extend for few months. Simply you just renew her contract for 2 years then in June 2008 asked her to resign.
