Employment Ordinance

Is any mum mum works as a sales, and earn the basic salary plus commission?
I want to ask some question that
if the employment contract declared that employee will not entilte the commission after they left the company. Is it right? (Commission maybe release after few month in normal)
But Employment Ordinance has declared that commission is a part of salary, employee should entitle their salary within 7 days after they left.

Anyone face the same case??

人工包括佣金及津貼.
任何情況下離開公司或截糧後
公司應7日內出糧給員工,
否則違犯勞工條例.

but we have signed the employment contract,
it shows that we cannot entitle comission after leave,
then is it affect the employment ordinance espirit?

And Mrs Chan , have u faced the same situation or u work in labour department?

你簽的 employment contract應屬無效,
因低於勞工法例,
難道僱主要(迫)僱員簽不合情理的合約都能生效?
所有打工仔都受勞工法例保障.
遇到不公平的, 不要啞忍.

第三章:工資
工資定義
工資是指僱主以金錢形式支付僱員作為其所做或將要做的工作的所有報酬、收入、 津貼(包括交通津貼、勤工津貼、佣金、超時工作薪酬)、小費及服務費,不論其名稱或 計算方法,但不包括:
賞贈性質或由僱主酌情發給的佣金、勤工津貼或勤工花紅;

I have asked a friend (lawyer), she also say the commission is not part of salary!!!

Then what does it means of 津貼(佣金)??

I would like to know which kind of comission is not for 賞贈性質!!!

Anyone can help!!??
