我地去旅行,會比個工人放大假,佢選擇no pay leave,
咁期間夾有一日公眾假期,咁係咪即係個日我應該要照pay佢架呢?

咁呢段假期既星期日(即原本佢每星期應有假期),係咪都要比返錢佢,唔扣佢錢?

No pay leave 嘅意思, 係嗰段 period 都係 no pay, 不用俾 公假 or sunday 的pay !!!

但有薪年假都唔可以扣休息日同勞工假,點解無薪假反而可以?

我老公問左a準喇!
gemiling o岩呀! 2days sunday假同1day 公眾假期都唔納入no pay leave裡面呀,即係呢3日唔可以扣佢錢。

再講多次:No pay leave 嘅意思, 係嗰段 period 都係 no pay........
假設你僱員放2個月 no pay leave, 你係咪抽哂d 紅假同 Sunday pay 佢?
又或者, 如果放 no pay leave 唔係全段時間都係 no pay, 咁全人類都揀2月2日
放到2月7日啦, 扣兩日人工, 放足6日假!

但而家係幾日唔係1或兩個月,而no pay leave 係要雙方同意嘅,工人根本唔可以話有著數就放。掉轉頭,如果照你咁講,好多僱主都會要工人新年放幾日no pay leave就慳返三日紅假同兩個星期日?

無論paid leave or no pay leave 都係要僱主同僱員協商 (雙方同意)
重申:夾响 paid leave 裡面嘅勞工假及休息日先要 pay
no pay leave係唔駛
no pay leave 就係 no pay leave, 唔會因為放長d 同短 d 計法就唔同
即係唔會長嘅no pay leave就唔駛 pay Sunday, 短嘅就要
香港只有一套勞工法例, 外傭同我地打工用嘅勞工法係一樣, 有乜可以打去勞工處問!

yes that period is no pay. But doesn't mean you have to deduct the money for the public holidays.

For example, if I am taking no pay leave from today to monday. I am actually just taking no pay on 14, 15,16 and 18. Since 17 is sunday. It doesn't count.

That means for this month's salary, my boss can only deduct for the 4 days instead of 5 days. Cos sunday was public holiday.

Just like when you apply for annual leave, you will not count all the red day and sunday into your annual leave.

ok, maybe this is easier to understand.
Since employee already entitled to 勞工假及休息日. when they apply for leave, those days are already given. and so they will not count as their annual or no pay leave.

What you said is for PAID LEAVE and NOT "no pay leave".

簡單d講,你地只係需要比有做工的日子, 無論佢放假的日子有無紅日,都無需比錢. 如4/1-4/10, 你無須理會有無紅日, 休息日, 你只比佢做野的日子, 即4/11 - 4/30.

to start with ... sundays are not paid. cos those are not her work day.
SO you can just ignore that.

agree, no pay leave就係no pay leave, 唔駛俾當中休息日同法定假, Sandra哩個例子好啱, 難道員工請1個月no pay leave, 僱主就要出4日休息日人工俾僱員?

吾知大家有無放過產假?
記吾記得, 公司係將你成個月既人工X4/5
而吾會將SUNDAY/PUBLIC HOLIDAY 的人工扣出黎比FULL PAID, 其他的比4/5..........
我印象有無錯?
同一道理, 係吾係應該APPLY 係NO PAY LEAVE 樹呢

這題目好有趣,所以我今早打去勞工處熱線問。答案係: 法例冇要求妳要畀那夾在無薪假內之休息日〔或法定假)人工。
所以,僱傭双方在申請無薪假前需協定/共識去扣那連着的休息日工資,還是不扣。。假設你想扣她那連着的休息日人工,那就在批准假期之前,先告訴她你会這ㄠ做,如她同意,那就批准放。如她不同意,那么就達不到共識,那就不批准她放吧!(那職員真係咁答我。)所以Sandra係岩既。


The staff member explained the ratinale behind is that there has never been any stipulation in the Labour Ordinance specific to handling of No-pay leave. SO, whether to deduct her rest day salary consecutive to the no-pay leave days, would be left to the employer-employee to compromise on signing of contract. Else, if not laid down specifically, (like in our case, standard contract signed for hiring FDH), then to be compromised right before the employee's application for her no-pay leave. In this regard, employer has the right to state out his condition for approval of such no-pay leave, which is, to deduct the rest days' salary consecutive to the no-pay leaves. If the employee doesn't agree to it, he has the choice of either not taking no- pay leave; or, simply quit the job if he really wants to be off on those days.

But of course, to be generous, you may opt to simply pay her like usual (not to deduct)on those rest days. You know, everybody has her own perceptions/reasons in mind. We might have worked in different companies ( with varying practices in such matter), which may make us flattered that the ways used by one particular company apply to the rest.


Whatever, hope the debate comes to an end.
