各位媽媽,

我老婆和女兒回港已經8個月了,她們是拿綠咭, 我知離開一般不能超過6個月,請問:
1) 人在香港, 我在美國可否幫她們申請回美証?
2) 我現在可以幫老婆和女兒做一些什麼,令她們保持
綠咭身份
請有此經驗的媽媽給點意見!

你呢個問題都幾難答~
因為一般揸綠咭真係唔可以離開美國境超過6個月,
而申請回美證方面我都可以答埋你, 係唔得既~
我媽同你家人既情況差唔多, 佢返左hk仲耐,
之前佢都有揸回美證, 但就係連證都過埋期,
所以, 佢今次返美國時, 個心真係15, 16,
不過, 可能佢係老人家, 同埋佢唔多識英文,
咁佢入境時, 都係話出左去5個月咋~
好彩今次就俾佢入番黎囉~
但依家入關時, 持綠咭人士係要打手指膜既,
所以, 我諗佢下次入境時想再呃下都唔得啦~
我媽之所以又要入番黎, 係因為我媽人在hk,
佢叫我妹幫佢申請回美證,
以前就咁申請都ok, 依家就唔得,
要去center果度打埋指膜, 所以, 佢就要冒險飛返黎囉~

Information on applying 回美証:

On page 2, it mentioned:

If you stay outside the US for less than one year, you are not required to apply for a Re-entry Permit. You may re-enter the US on your Permanent Resident Card (Form I-551).

As far as I know, a green-card holder can leave US for over 6 months, but less than 1 year, without applying re-entry permit in general.

No. In general, they need to apply re-entry permit when they are still in US before they leave the country. Though I think I read somewhere that if they have a valid reason to explain why they need to stay in HK for an extended time (e.g. unexpected medical reason etc), you can do something else.

If it's possible, you can have them come back to the US before the "1 year" time, and then apply for the re-entry permit if needed (if they are going to stay in HK for another year).

My uncle has green card and my auntie is US citizen. My uncle returned back to HK to work and he often leave US for over 6 months each time (but less than 1 year) without applying re-entry permit. However, each time, my auntie also back to HK and then go back to the US with him. The custom didn't give him any trouble. He did that for a few years already.

Just a reminder, if you plan to apply for US citizenship in the future (for your wife etc), those long-stay in HK period will break the continuity of the required continuous residence in the US. It may not be a big deal for those who doesn't plan on applying for the citizenship (sooner) though.
