{Your question won't have a definate answer. Size of the company is not the matter, I can only offer afew pointers for you to consider.
1) Does the agent conduct the selection and interview of maid personally? Many said they do but look out for prove e.g. Do they have photo taken with the applicants. Many just take from supplier without personal knowledge of the applicants.
2) Make sure its not a fly-by-night company. A company with minimum history of 3-4 years will be a safer bet.
3) Try asking more questions about handling of maid to test the experience of the agent and judge yourself to see if the answer given is sensible.
Since you already have in mind the type of agencies to choose, I suggest you go to both to see their files and gadge them.}
{Your question should be directed accordingly to your own family needs. Select those that can match their past experience as close to your own family situation and needs.
Other things to look out for:
1) Prove of her job experience e.g. ex-HK employer's reference letter and contacts details. Ask if you can call her ex-employer to check.
2) Her passport to check on her visa date to verify what she say is the truth. Calculate the date in accordance to the finish contract date.
3) Listen to her English accent to see if you can understand what she is saying comfortably. Give her question that requires longer answer, like asking her to introduce herself and her family.
4) Ask her back about her own expectation like when can she start, is she going back home first before she can start working for you etc..
Lastly, verify clearly what is included in your agent services to avoid any misunderstanding.}
本人是新的成員,I've some questions about the D.H. contract that want u to help me !!!
Thanks a lot!!
First, my bun bun's D.H contract date is start on 4/2/2005. So, i just tell her that i will not continue to employ her after 3/2/2007 since 3/1/2007(the reason is i will be a housewife). Few days later, she ask me to release her on 10/2/2007 because of her working visa. Then, i just say OK without asking any question!
Last week, she tell me that it's has problem for her to find the job due to the working visa(too early to release ), i just tell her to ask immigration for help ! So , today's morning i ask
her about the date of working visa so that i will go to the immgration to ask some questions for myself.(she just tell me the date is 9/3/2007)
When i ask the officer(immigration) what is the date that i can release the helper (10/2/2007 of the visa date 9/3/2007)with the reason for complete contract. He tell me that 9/3/2007 is the helper's last working date.If i release her on 10/2/2007, then i were be illegal.
But now i have questions :-
1) which date is correct and will not be illegal ? a)10/2/2007 or b)9/3/2007
2) when i telephone to the Labour Dept., they tell me that i must give the severance payment to my helper because i will not employ another helper to work, (if not , i also illegal!!)is it also correct ?
As u know, i'll not work any more from 10/2/2007,if i release the helper after 9/3/2007, i'll waste of my money and time. what can i do to make the case no lose??
** the law is protect the overseas helper only, if i follow all the above terms, i'll use so much money !!! i just want to complete the contract and be a good mummy, why i need to pay so many ??????
{Since immigration had told you the last day of service is 9/3/2007 , that should be the visa expiry date and also her last day. Also, like what the Labour Dept said, severance payment need to be given if the helper had completed full 2 years contract and when the employer have no intention to employ a replacement.
Now about your case, this is what you should do...
1) You should still stick to your first date of termination given to your helper, last day of service is 3/2/2007. You had given her one month notice from 3/1/2007 (did you give her one month notice in a letter or just verbal?)
2) Your 1 month termination notice is due to you will not be working anymore (state in your Termination Letter as 'due to Finance Problem').
In this way, you have a win-win:
1) Your helper service is not finish contract, it is termination with good release and you don't have to give severance payment because less then 24 months.
2) Your reason for her termination is due to Finance Problem, your helper can still change employer in Hong Kong.}
1) I just give her verbal notice on 3/1/2007(i'm so stupid !!!!), can i give back the notice in a letter format ? (if / suppose the helper willing to sign and recieve)
2) if she reject to receive the letter of the above date(3/1/2007), can i issue a letter on the date of 23/2/2007? (that means i will give another 30 days notice on tommorow?) in this case, can i need to pay the serervance payment ?
3) if she ask the immigration later, and she still need to stay at my home until 9/3/2007, that means i cannot reject her (except i fire her) ?
*** because i don't want to break the good relationship between me and my helper ***
1) Pay her Severance Payment = 3400 x 2/3 x 2 years.
or
2) Follow what I mentioned earlier. What you give her is a good release and she can find employer in HK without going back (Why do you think it will break your relationship with her?). If you think she is really that good, you can also include your telephone for her future potential employer to call you and give her good recommendation.
If she finish her contract, you will meet all the trouble that had been worrying about. Both Labour and Immigration.
PM me your telephone number if you are still unsure.
