可以不經Agent，詳情請去菲律賓領事館問，因首要得到領事館批準你自己攪先可攪。

首先法例上係唔容許你/僱主收起工人既passport，佢一定同領事館/工會/勞工處...講怕/驚左你，所以唔敢返去你屋企。我諗你都唔駛諗點指她曠工，佢多數唔撈架啦。Call Agent問下工人想點重好喇!

菲傭借錢問題

We discovered our Philipines maid borrowed money from a financial agent as she did not return the $$ and the agent sent letters to our home address.

It has been 9 months already since we discovered she borrowed the $$$. She said she helped her friend to borrow that $$$ but her friend had already gone to Canada to work so she did not get the $$$ to pay off the loan.

My Qs :
(1) Normally when will the financial agent take further action in respect of the loan? depending on the amt or the 欠債期？
(2) we understand our maid could not pay off the loan and her contract would be expired in March 2008, should we wait for the contract end or we have to find another one now?
(3) If we do not want to renew her contract, when should be inform her?

Hi Mrs.Rose,

我本人2/10己上去 agent 度簽好所有文件, 咁agent 告訴我會 3/10到菲律賓領事館辦理手續, 我已同agent說趕要工人用,他們話已幫我寫了加快信給入境處喎, AGENT 話最快都要 12月頭才到, 這樣我想問是否正確? THANKS!

我工人係我度做左就嚟6年勒,今年應該續約. 我上一次諗住今個約完左就比奶奶睇住d仔女,所以同佢講過我會比長期服務金,但我個仔19個月都唔行,我奶奶話佢唔行,怕自己體力唔得,所以我今年年頭已經叫佢續,佢又話要問老公先,因為佢每次完約都想返印尼,但我有2個小朋友唔可以即刻放到佢走,我要同公司plan好都要續約後起碼半年先放佢走,所以佢次次都怕我唔比佢返印尼.佢今次7月話唔做勒,諗住有長期服務金,點知Agent同佢講自己走係無既,但Agent當時無叫佢簽名resign.之後佢我講大話,話比又唔比,但我話我一日要續你,都唔駛比住. 佢之後上左工會話佢好想要份工, 話我頭2年under pay. 公會打電話嚟又話告我,我唔怕我叫佢告, 因為工人11月6日完約,公會又打嚟問我做乜仲唔簽約,我話我會安排, 之後叫我工人再打比我話10月2日帶工人去領事館續約,我話要返工唔可以咁喎,我話我會安排...其實我可以點做呀:-( :-(

My case is almost similar as wawa's case. I hired a maid from Phili with HK experience from mid of June as my exmaid will leave on 1 Aug. After the process, the agent told me that the maid will arrive on 1 Aug,... Suddenly, the agent called me the last week of July said the maid cannot arrive on 1/8 due to some minor problem... tried to ask agent but she said just minor thing...and the agent said the maid will arrive next week.. then I said OK ... then I took some day off to take care my son la ...as nobody can help me to take care him... then the next week she called me again that the maid cannot arrive as the maid not enought money to paid the agent fee yet.. then I keep on chase the agent la... 13/8 the agent called the maid won't come to HK as no money wor.... then she gave some CV for me to chose.. as not many choice.. she recommended one overseas.. and I signed the contract on 15/8... then I called Immigration million times and luckily they help me to process and the replacement arrived on 14/9......

My nightmare started again... the new maid CV said they have 4 yrs Taiwan experience... 2 yrs take care a family (a couple + 1: baby + 1: 7 yrs boy), marketing, cooking, cleaning, bring the kids to school...etc.etc.... and 2 yrs take care a old women. When she arrived.. she said she only worked in the factory for the 2 yrs and only spent 2 hours NOT everyday to help the family for cleaning only... of course.. don't know how to cook, clean, take care my son, ... completely 0... then I called agent the second date she arrived and complaint.. she lie on the CV.. but the agent said .. be patient to teach her and give her time to learn wor.... I said I have no time to train her... and I insist to hire another one.. then I feel the agent tried to process very slow... end up I signed another maid on 2/10... and I want to send the urgent letter to Immigration, but the agent said I've no ground to send wor...

and now the maid since day 1.. she will give us impossible surprise everyday till now... etc.. forgot to bring my son to class la.. leave my son home alone and she go down to pick up something for us la.. etc etc... we asked to promise don't make any mistake.. she said.. nobody is perfect.. so she cannot promise wor... She almost make me crazyla....

我相信我是無工人緣的！因我大大話話用過六個工人，包括所有國藉，賓、印、泰甚至local part-time都試過！但有極吾衛生的，有飲醉酒的，又有偷的！自問對工人不差亦時常教小朋友善待她，家庭也簡單，一家三口加兩隻狗，小孩也中三了，不用她花時間照顧，每日跟她相歲最耐的就是兩隻狗！但現在這個個賓，來了四個月，之前曾在一個僱主做了七年，後回國結婚生仔，回來後不足兩星期就給僱主炒了，因不清潔及時常黑面！後在我大伯家中試工兩星期，己簽約但剛巧奶奶去世，不用她了，於是就改由我們重新申請她。她在我大伯家時己試過沒關火就出街放狗！艙所以她來我家時己千叮萬囑她要小心，只要善待兩狗就可以了！第一個月尚可，但第二個月開始問題己出現，試過同我小狗出街沒用狗繩小狗衝出馬路給的士撞倒！一星期後不將衣櫃躺門關好，因衣櫃有問題己叮囑她要小心，誰不知沒有，我開櫃時整個八尺門跌下，我腳趾骨碎了！但她一句sorry也沒有！有時check她買菜錢也試過不確。也試過煮早餐後忘記熄火，幸好我發現，又將大門key插在門外忘記了，給屋苑security發現!病到死不停咳又不肯用mask,幾經辛苦才肯去看醫生，前幾天看完醫生後發現她沒吃藥，問她還死撐，直至罪証確鑿就不出，我將所有過錯記錄低，但agent話她自已寫才有阻嚇作用，我前天叫她寫但我今天問她，她說不因她有權refuse!並很大聲兇我！我agent叫我忍耐多一下直到她找過另一個給我！我看過榮工處網頁如a果habitually犯錯屢叫不改，我可以不用補她一個月，但agent話不可以。己決定炒她，想請問一下我是否一定要補extra一個月？請指教！忘了最主要一樣，直到今日我兩隻狗還很怕她，死也不肯跟她，還掉頭走，我也不知她有否虐待牠們！？

唔續約及遣散費問題
1) 如果剛做滿2年, 唔續約的話, 使唔使比遣散費??
2) 如果唔續約, 需要最少幾耐之前通知工人?
3) 如果做左23個月, 炒佢, 給工人一個月通知, 使唔使比遣散費?? 仲要比d 什麼費用??

ANS:{Depends on that finance company.}

(2) we understand our maid could not pay off the loan and her contract would be expired in March 2008, should we wait for the contract end or we have to find another one now?

ANS:{Don't be surprise that she runaway before end of contract term. The finance company don't only send payment reminder. Start looking for a replacement now.}

(3) If we do not want to renew her contract, when should be inform her?

ANS:{No need to inform her. If you want to be subtle, you can just ask her what date would she like to fly back at end of contract so you can start booking it for her.}

法例從來無講，出警告信警告過工人3次或以上，就可以即炒而唔洗補一個月人工比工人。至於簽僱庸守則，係法律上亦唔係好有用，當然白字黑字寫清楚都有好處，要工人知你既家規，等佢唔洗扮唔明/知。 ...

如果你agent 真係 3/10到菲律賓領事館辦理手續, 而家就應該入左入境處，你要問Agent幾時入visa，入左加快信後visa一般4星期可出，即例如10/10入visa，約10/11前會出visa，應該大約20/11可到港。

我看過榮工處網頁如a果habitually犯錯屢叫不改，我可以不用補她一個月，但agent話不可以。己決定炒她，想請問一下我是否一定要補extra一個月？請指教

呢一句 "犯錯屢叫不改" 可圈可點可大可小，但法例亦有提醒僱主，炒人又唔補代通知金，係要犯好 "嚴重過失" 先可行。所以你如果真係覺得有理據，唔想補她一個月，就唔好俾等工人去勞工處告你時，你就將你既理據一五一十咁講清楚，等主任話你知你駛唔駛俾，你再決定俾唔俾。如有需要可PM手電再詳談。

1. 唔續約而你又唔再請工人，就要俾遣散費。相反你繼用工人就唔駛俾遣散費。

2. 唔續約其實唔需要通知工人架，除非你要佢提早走，因係佢passport裏面已有完約日期，所以工人唔會唔知幾時完約。

3. 遣散費參照(1)、另机票，大假及Food & Travelling allowanceHK$150.

我點會唔答你呢! 只不過近排日頭公事忙上唔倒BK，因每月起碼飛3次大量文件要跟進，放工後私事亦忙因為兩位大爺考試，攪到我嚴重偏頭痛發作，晚晚超過12點先可上BK，寫兩寫就勁頭痛，所以遲左覆大家。敬希原諒...

再問
1) 其實, 我意思是我不再同現任的工人續約, 不過, 如果經濟許可, 我寧願另外請個一個工人, 我應該點寫release paper, 遣散費點計?? 點樣可以保障自己多d??? 如果是合約制, why have 遣散費 after 完約??

3)做了23個月+炒佢, 比一個月通知, 遣散費點計??
