Terminal Pay

相信大家都知道工人做夠5年要俾長期服務金(人工 x 2/3 x 5yrs)。但最近從朋友口中得知工人完成兩年合約又唔續約,都要俾terminal pay (人工 x 2/3 x 2yrs)。而家好多印印都知,所以經常告僱主冇俾呢筆錢。朋友仲話差唔多100 %告得入o添!對僱主實太唔公平啦!!

Yes, you are right. You should pay 長期服務金 when the domestic helper has finished 5 years.

About [[terminal pay (人工 x 2/3 x 2yrs)]] you mention above. I think you misunderstood the labour law.
If your domestic helper has finished 2 years contract and you do not want to renew her contract. You will employ a new domestic helper to replace her position. You do NOT need to pay any Compensation. {{as you said [[terminal pay (人工 x 2/3 x 2yrs)]] }}

BUT, if your domestice helper has finished 2 years contract and less than 5 years. Once you terminate the service contract and will NOT employ another domestic helper to replace her position. At that time, you should pay Compensation. {{as you said [[terminal pay (人工 x 2/3 x no. of yrs)]] }}

Do NOT mix up. You could go to Labour Department website to double check for it.

對! 只要做夠"24個月",就算她滿約,而你不再和工人續約或炒她,她都 "有權"去告你無理解僱而要求終止服務金(不是長期服務金,但計法一樣).

但告唔告得成

唔一定做滿兩年,都要畀遣散費架,只要僱主即刻請返人,就唔使畀.

你唔使驚喎,唔好畀啲外傭嚇疾呀,佢哋大多係搏大霧,因為佢哋大多都知道香港人時間就係金錢,唔得閒同佢哋玩,所以佢哋就用告僱主呢招,佢哋知道好多僱主都無時間上庭,怕麻煩,所以大多願意庭外和解(就算知自己有道理都庭外和解),畀幾千蚊佢,了左件事就算,買佢怕,我成日都講只要自己行得正企得正,又做好準備功夫,最緊要唔好怕煩,一於同啲衰嘢玩到抵,咁仲使咩驚呢.

其實喺封合約屆滿通知書度寫唔續約嘅原因,最好唔好咁好心,寫佢做得好好,最好寫係個工人唔願意同僱主續約,呢個係最仁慈嘅寫法,如果個工人唔接受,就寫個工人喺合約期內,都未能做到僱主要求,所以不被續約,仲有,以前有媽咪提過,話可以喺封通知書度加埋一句,話係個工人同意唔續約,同埋唔會告僱主,咁就唔使畀個工人有機可乘了.

遣散費:
1. 根據連續性合約受僱不少於24個月
2. 僱員因裁員而遭解僱
3. 有固定期限的僱傭合約在期限屆滿後,因裁員的理由沒有續訂合約
4. 僱員遭停工
**若僱主在合約終止日或合約期限屆滿日之前7天內,以書面要求僱員續訂合約或以新合約重新聘用,而僱員不合理地拒絕該項要求,則僱員無權獲得遣散費。

裁員的定義
僱員若基於以下原因被解僱,即視作因裁員而被解僱:
僱主結束或準備結束營業而解僱僱員;
僱主停止或準備停止經營僱員受僱的工作場所而解僱僱員;或
僱主對僱員所擔任的工作,或對僱員在其受僱地點所擔任的工作需求量縮減或預期會縮減而解僱僱員。

My friend faced this case as well. When he did not renew the contract with his bun who worked for him for 2 contracts. He told her he was not going to employ a new maid. Then the bun asked for the compensation. So he went to an agent & "register" he wanted to find a new maid to replace the old one in order to prove that he will employ a new maid in the new future.
