印印今日話resign,我想請返以前個菲菲,但佢和現僱主未完contract,但係佢做得唔開心,一個人做2千幾呎屋,照顅4大2小,朝6晚1,連工人房都有IP Cam.佢想一個月通知現僱主resign 返黎.想請教各位, Does she need to back Phil, how about go to Macau, It is Ok? I urgent need a maid because both me & husband need to work in day time. Please help.

She work at my family almost 8 years and we all like her. she back to Phil due to his husband have a girl friend & she want to settle the case & take a look her son.

咁又唔同喔。如果佢已經幫佐你8年。應該都信得過既。你可以搵agent安排佢去大陸一轉，然後拿旅遊簽證（多數會有一個月）。然後等新visa出。記住申請時要有加快信。最快可能6星期會出到visa。不過其實咁做係走法律揧。而且未出visa係你家工作也不合法。按照法律，佢就要返菲律賓先。

照計佢已經係香港滿7年, 已經係合法逗留喎. 應該唔使靠agent搞之餘, 仲可以自由搵工架. 佢呢d情況咪似我地香港人咁搵工咁囉. 如果其它斷約工人, 再同你續約便須要先返原居地申請過來, 工人仲要比agent公司約3個月agent fee (印傭係咁, 菲就唔知係咪一樣)

Just checked from Labour Dept's website, saying that domestic helpers are not allowed to stay in HK if not under employment contract (except 14 days of stay after contract expiry / termination), and thus they should not be 合法逗留 after working in HK for over 7 yrs.

"附註 6 6 . 傭工不准來港定居，亦不能攜同受養人來港居住。"

外傭係唔可以因為係香港做滿7年就可以拿到居留權架。

When she can come

Thank you for all your reply. She gave 1 month notice to her employer & leave on 22Apr. My I know when she can come to my home. Is it possible to go to Macau instead of Phil. Both me & my husband need to go out for work in day time. My 2 old dogs always barking when nobody home. ( Management company send warning letter to me about this before). This is the main reason why I need a maid to stay home in day time & no any family can help. Is there anyone have a suggestion.

其實係可以既，不過咁係走法律揧。法律規定未完約工人一定要離境。不過佢未出到visa前係你屋企做野係唔合法架。

1) 未完約(就算佢自已resign), 都一定要返philippine先, 我宜家屋企果個bun都是自已resign, 我再請佢, 佢都要返philippine再返來.
2) 就算佢之前在香港做左8年, 佢每次完約(2年)佢都要出境先, 再入境, 由頭計過, 點都吾係hk 居民, 當然吾可以留下找工.
3) 佢4月22日離職, 佢一定要留多兩三日在港先, 叫佢住boarding house, 你要搵定agent同你做direct hire手續, 之後佢要返philippine先, 等visa出, 再等philippine果邊搞過黎, 最快都要6星期才可以到港 (我之前都不停send fax到入境處,因為我前一任bunbun話家中有事, 返左佢無再返來, 我都急到死死下, 最後放在亞仔在育嬰院).
4) 我都有問過是否可以叫bunbun去macau或china, 是可以的, 不過都吾會快好多, 都要成4-5星期, 我都有問我宜家個bun, 佢真的吾想去macau或china, 佢想返philippine見下個女, 另外, 又吾係快好多, 所以最後我都比佢返philippine. 佢要佢去macau或china, 你要比食住費用.

我以為去Macau stay 2-3day, 如果要4-5 week, I prefer she back Phil to take a look her son instead stay alone in Macau. May I ask you a question below:
1. Can I process the direct hire how?
2. How much of the agency fee ?

sorry, 有時我無時間上網, 所以宜家先答你.
1) after you get vca no, 你可以send fax to Immigration, agent 是不會幫你send的, 只會教你點做. 我就send左3次, 直到有人contact我.
2) 我當初都以為去macau會stay好短, 原來吾係, 只會比留在hk快1-2星期, 所以我都吾想個bun咁慘, 留係china.
3) 你可以問下agent, 你幾時可以process, 因為我同你的情況吾同, 我個bun已經離職, 所以可以立即做process.
4) 你最好問多幾間agent, 最好有朋友介紹, 因為收費吾同, follow up 亦吾同, 有d你急佢吾急, 亦有好多agent吾鍾意做direct hire, 因為佢地吾可以收個bunbun好多錢. 我問的時候, 就有2種收費方法:
a) 收employer $4000(在hk比), 之後收bunbun$2000(bunbun返philippine後比philippine間agent), 全費約$6000
b) 只收employer $6000, 你自已同bunbun傾點收佢果份.
$6000包齊philippine到hk的airticket, 接bunbun到agent, 包驗身, 包visa錢.
