If Pregnant..........

My maid will go to Philippines for vacation. Although she has two sons already. But I still afraid she will get pregnant. Anything I can do in advance or after she come back HK? If she really get pregnant what can I do?

Do it in advance...
1. Remind your domestic helper do not pregnant during her holidays back to Phil.
2. Draft a Resignation Letter and ask your domestic helper to copy it by handwriting and sign on it. Of course you keep the letter. You explain it to her if she pregnant after her holidays, she will be terminated.

Do it after she back...
1. Ask her if she pregnant or not on the first day she back.
2. Collect her urine in three days after her back, do urine pregnancy test. Make sure the urine from your domestic helper and not diluted by tap water. [Urine pregnancy test can buy from Watson's or mannings, etc.]
3. Do not throw the resignation letter even the pregnancy test is negative untill her period came.

最好打定避孕針or 寫定離職信兩份。一份,生效日期是放大假後,怕他不回來。另一份回來後三個月生效,如果有了當自己走。

Help!

My maid will go back to marry after 1 month but she refused to
sign the resignation letter
&/or receive the injection.

She can't promise not to be pregnant after the holiday & she said she still can work for us even though she is pregnant.

Moreover she also demanded the
long term service payment
even though if she resign & terminate the contract
early.

Help!

What can we do?

Before I comment on your case, please explain more details in your case.

How long has your maid worked for you ?

Does she intend to work for you again after going back to marry ?(i.e. she just goes back to marry on her holidays.)

1) She has the right to refuse sign the resignation letter or receive any medical treatment. We can't force her to do it.
2) Well, as she refused to sign the resignation letter / receive medical treatment, you could take other option that give her a Release Letter [Termination Letter] and ask her to sign it back to you. You keep the original copy and do NOT let her keep any copy. Of course, you explain it to her if she get pregnant after the holidays, the Termination Letter will valid at once otherwise you will throw it to the rubbish bin. {{{PS. In the content of the termination letter, you give her one month notice and the date is one month before she back to Phillipines. So, you do not need to pay her one month salary in lieu of one month notice}}}
3) About the ""Long Term Service Payment"", who's finished 5 working years can entitle long term service payment. If your domestic helper has finished FIVE years, once you fire her you should pay that money.

If I were you, I will terminate her contract and give her one month notice. The last day is the day she back to Phillipines for getting marriage. You know why, ONE) she does not promise that not to get pregnant during the holidays TWO) She said that she would work for you even she got pregnant. I must pay her 4+6 weeks for her maternal leave, and take care of her during her pregnancy. We employ a domestic helper to HELP us, right. THREE) Terminate her contract at this moment is the best time because she want back to Phillipines in hurry for her marriage and she won't play tricks on us. {{{These only my opinion}}}

after she knows she is not entitled
she demand 1/2
or
she comes back after her marriage leave
& finish the contract.

But she cannot promise not to be pregnant,

Seems nothing we can do!

KK parent,

the problem is actually on her
we intend to let her work until Dec 2005
it's only her giving us very short notice
that she will marry in June

if we dismiss her on our own
we hv to pay the long service money
which is >13,000.--

it's unfair to us
we don't want to break the contract early.

Your story seems so complicate rightnow. At the begining, your domestic helper wants quit the job and get back the "long term service payment". After she knew that she could not entitle "long term service payment" and she just want holidays back to Phillipines get marriage.
I just know she wants MONEY for her marriage. She works for you almost Seven Years, you should think about it. Fire or not, upto you. I am thinking, she will be pregnant in Phillipines and back to HK and then force you to terminate her contract and get the ""Long Term Service Payment" [ HK$3270 x 2/3 x 6]
