URGENT

我個工人有急事要回菲律賓,我想問有乜要注要。
同埋我是否需要比封信證明佢在HK有僱主呢(當佢入HK境時用)?如要,請問有無SAMPLE可給我?

1. Ask her to give you a Resignation Letter and sign on it.[Handwriting] Make sure if she does not show up after the holidays, you can re-employ a new domestic helper. Otherwise you should wait until the contract end.
2. Ask her to sign a Liability Agreement which she take all responsibility during the holidays in Phillippines that included the medical treatment and personal liability.
3. Perform a Pregnancy test after she back to work that make sure she wont get pregnant.
4. You do not need to pay any fee about this journey. That's not included in 2-yr contract.

and also ask her to sign a resignation letter for your keeping. In case she will not come back to hk by the agreed date for whatever reasons, the contract will be terminated on the date. I have some friends where they have similar bad experience before. Some even out of sympathy, gave the helper advanced salary, briefcase for their use etc and end up the helper didnt return and could not be contacted. The resignation letter you ask them to prepare now is to protect you when this 'unfortunate siutaion' arise

昨晚,我已叫佢handwriting左一封resign letter給我,另外,叫佢寫明係合約完結前不可懷孕。我想問是否要佢再寫明,如佢意外懷孕,佢要自動離職。(唔知咁樣寫可以嗎?)

I think it should be two separate letters.

The first one is a resignation letter about the agreement to terminate the contact prematurely on (the date she supposed to return to hk) because of her personal reasons etc. This letter will be kept by you for producing to the immigration department in case your maid does not return to hk on the date as agreed.

A second letter about her application to you for early termination of the contract on the reasons that she is pregnant and that she will need to go back to Philippines for good. (in other words, it is the maid who terminates the contract because she is pregnant and not you who force her to terminate the contract because it is against the regulations and if she makes a case to the labour, then there are previous rulings that the employeer had to pay compensation based on 10 weeks' salary that the maid is supposed to entitle if her contract is not terminated). The second letter if drafted in this manner, the maid cannot claim you.
