我朋友想炒左個已續約舊工人

我個朋友今年二月與舊菲藉工人續約﹐當時已同意讓她在五月底才返去放大假﹐但近日友人甚不滿意其表現﹐很想炒左佢﹐請問佢現在是否只需比一個月代通知金一張返菲的機票

Ask your friend to be careful!

I remember there was another similar case posted by BK members. A friend renewed the contract of the helper and fired the helper after a few months because a lot of small problems and decline in work quality after the renewal. The friend didn't issue any warning letters because they were small problems only. The friend complied all requirements to give one month's pay in lieu of notice, plane ticket ...

At the end the helper sued the friend for unreasonable dismissal and won compensation of HK$60k. The judge said if the employer could renew the maid, the performance couldn't be so bad. So without any evidence (e.g. warning letters) it was hard to believe the friend's claims that the helper's work deteriorated a lot in a few months. The judge decided in favor of the helper and granted her the compensation.

Therefore please ask your friend to really "plan" for termination. Collect evidence of misconduct or dissatisfied performance, document it with warning letters to be counter-signed by the helper, send to agent for reference, I read somewhere that it may be necessary to send a copy to the consulate, ...

Otherwise if the maid play games, she will go to the union and the union will teach her all the tricks against your friend.

真係不吐不快!個judge 咁嘅reason, 就令我覺得好唔合理 - 點解工作態度唔可以係續約後急轉直下?我自己之前續約的菲傭, 工作態度都係續約後變差, 所以我都係同佢續約一個月後就炒左佢.同埋啲工人續約後變差, 係bk都時有所聞. 都補足一個月的通知期/通知金和其他錢, 點解仲要倍成60k?佢跟據合約上那一條文或法例?不過香港對外傭的保障多過對我地呢啲本地人僱主, 亦不是新聞. 總之如果對個外傭的工作態度就算少少唔滿意, 都唔應該同佢續約, 免得勞氣又花錢!

啲官點會明白啲小僱主嘅慘況丫,啲工人一見到佢哋門口又高,狗又大,仲係官添,仲點敢作反丫,所以啲官點都唔會好似我哋咁受苦,總之我哋點講,啲官都唔會明白的.

如果算二張約已經生效,就需付第一張約的回程機票, 第二張約的來回機票, 同埋travel allowance ($100/day of travel)."機票"係指返到佢的place of origin - 卽如佢返到菲律賓後要轉內陸機或車,僱主都要付那一程交通費.而因第一張約的14天假未放,仲要補14天的工資.之前係bk好似話最好不要以錢代機票, 同埋要是open at least for 14 天的. 因為完約後個工人可以留14天, 佢有權要求14天後才走的機票.

「第二張約的來回機票」比佢又用得著咩?
如果佢係14天內找到新僱主都有一張來回機票﹐我朋友比佢都係曬左啦!
如果佢找不到新僱主﹐佢都拿住張機票冇用呀?

還有, 我都係最近先知, 原來繼約的工人, 第3年有8日大假, 第4年有9日大假, 第5年有10日...一直增加至14日大假.

所以我諗你朋友呢次都幾重皮.

佢用唔到係另一件事.但係錢就一定唔會比黎代機票.因為收左都可以話冇;又或者佢使晒.僱主都要再出過另一張機票比佢.

I have the same case which I paid her around $9,000 (return ticket by cash) + one air ticket to Phil.

PaPa, 工人用唔到張來回機票係佢的事.但如果你朋友唔俾第二張約的來回機票(或以錢代機票), 去到官到就係你朋友理虧--因每張contract都包to & from 個工人的place of origin. 俾來回機票就保障個僱主,因為已經跟合約做足. 以錢代來回機票, 就益個工人. 如果佢去到個官到,就睇吓個官點.我之前係俾一張來回機票, 再加以錢代一張單程機票.因個工人已經買左來回機票,打算放完假再返來,咁係佢走之前嗰晚炒佢.至於第二張約的假, 好像係如果張約開始唔夠三個月不用俾.如果唔係,都要按比例計返錢俾佢,最好問清楚入境處/勞工處.呢啲錢唔save 得.

無論俾機票或錢,要每一個item list 得清清楚楚, 之後要個工人簽收.咁就算佢第時話無收過,都有証明係佢講大話!

U better check the Ordinance and agent, according to my knowledge, there is no need to give her one return ticket +1 ticket to philipines if the contract is terminated. According to the Ordinance and the contract, all you need is to pay for her expense to Philippines and her place of origin ie her address in the contract.
Also, there is no mention on which type of transportation has to be provided. In other words, what is considered reasonable. Thus an open ticket to Philippines (Manlia) for 14 days and then if her place of origin is not philippines, then you may either pay her expense such as karto fee to her home town (check with your agent). Some employer if their maid is good will give a direct air fare ticket to the maid so that they can fly back directly to her home time without spending much travelling time. Of course, this will be a lot expensive but given your situation, it is not worthwhile.

You need to make her sign receipt of eveything that you paid her, travelling expensies, airticket, compensation, salary etc.
