I want to know if there is any alternative can be provided to the DH for not leaving HK when her existing contract is completed (we will renew her contract). She also agreed it but is it illegal?
Seems difficult. Hong Kong Labor Laws is much more on DH side than employer. If they insist to leave before their contract finishes, unless you terminate her but you have to compensate them for airticket, annual holidays leaves, etc., even though you can compromise with her on one month leave pay. Also, DH, especially Filipino likes to tell lies, be careful.
I have signed a contract with 在港菲傭 by 自行聘請 method and the contract stamped by 菲律賓領事館 but not yet go to the HK Immigration Department to extent the Working Visa. Is the contract valid and executed?? Because I want to employ another helper (indonesian) now. Shall I need to paid for the 在港菲傭 for one month salary and the air ticket?? How can I terminate the contrac with the 在港菲傭??
