Please advise:

My hubby and I are both Hongkongers and holders of Australia PR. We will move to Oz for good this year (meaning we haven't stayed in Oz for 2 years). If we will give birth to a baby next year, where should I deliver in order get both HK birth cert and Oz citizenship? Is it possible and how?

if you are both PR, the only way for your baby to have 2 passports is deliver the baby in HK. no other option.

Birth 15/3: W:4.2kg L:52cm HC:37.5cm

Yes, give birth in HK is the only way as far as I know.

In our situation, both of my kids were born in Oz. I am an OZ citizen & my habby is PR. & both of my kids are holding 2 passports as we are now residing in HK.

I considering to deliver in OZ due to the better medical treatments in Sydney.

如果小朋友不是在香港出世, 但父母有HKID, 就要在香港住滿7年才可以拿到永久身份證.
我親人的小朋友在澳洲出世, 有次回香港住一年, 家人幫手申請身份證都被rejected, 說要住滿7年才行呀.

所以, 也沒所謂啦, 孩子在澳洲出世, 將來大個真的要回香港生活, 可以等住滿7年, 不就拿到特區護照了.

I don't think you can apply HK passport if you are holding the HKID which grant you with condition 住滿7年. (no 3 stars *** ??)

Heaps Philipino maids in HK are holding HKID becuase they are working in HK over 7 years, but I don't think they are eligible apply HK passport.

I am not sure but just my thought!

also, as far as I know, if you are not holding HK passport, you are not eligible to apply China Home Return Permit. (someone please correct me if I am wrong).

hillgrove Regardless of how many years Filipino maid lives in HK, they are not eligible for citizenship in HK, but for other expat if they live in HK for 7 years or more they can apply for residency in HK. 發表於 11-5-29 20:30

妳說得對, 我親人的孩子應該不能申請特區護照, 因為孩子的父母已是澳洲citizen. 只能夠申請香港身份證.

要取得特區護照, 最保險的方法是在香港出生.

According to the HK Immigration info, your overseas born children are eligible for HK residency & a HKSAR passport if (at the time of application) either you or your hubby are a Chinese national (holding a HKSAR passport) and the children are NOT a citizen of the oversea country- since China will not accept dual nationalities. So perhaps you do not apply for your Aussie citizenship until you have obtained your HKSAR passports for the kids.

My boy was born in Sydney.
I was a PR, holding HKID and HK passport with Chinese Nationality.

I tried to apply the HK passport in Sydney for my boy (he didn't have OZ passport at that time), but HK immigration rejected my application. If your information is right, why my application has been rejected??

If we apply the HK passport in HK, he has to apply the OZ one first in order he can fly to HK, so, shouldn't work this way?!

I can tell you by the time my baby was born, he is Aussie regardless if he is holding the OZ passport or not because I was a PR.

I've been told some of the australian born babies/toddlers have both australian and HK passports, I just don't know how it can happens. Perhaps, the lack of experience of THAT immigration officer?

關於中國公民的資格, 有很多條件, 很複雜.
我猜想, 如果孩子的父/母, 有一人仍在香港居住, 就合資格?

所以結論還是在香港出生好了, 若真的很想孩子有特區護照的話.

Here I get your consensus that the first step is to deliver my baby in HK. But anyone know the concrete steps next?

Should I...??

Step 2) After baby born, get the HK birth cert and apply the HKSAR passport?

Step 3) Return Oz to get the "OZ birth cert"? (Any such thing in Oz?) Any restrictions on the no. of days return?

Step 4) Few years later, when the HKSAR passport is going to expired but the kid is having dual nationality, anything special when renew the passport? Is it essential to keep renew the passport and don't terminate it, otherwise cannot re-apply the HKSAR passport?

Dear all,

Surely, it eliminates much dispute when the child is born in HK, to a parent with permanent HKID or of chinese nationality (thats why all these mothers come to HK to deliver their babies), the child will get the HK residency. But even with HK residency the child may not be granted a HKSAR passport, eg if you have declared yourselves as foreign nationals. But if you haven't made such declaration, then as a HK resident of chinese descent, you will be seen as a Chinese national and no one will bother asking.

Mrs Kangaroo, believe it or not, there are many ppl who can obtain a HKSAR passport for their kids in the same situation as yours. There must be something which you have said or mentioned (eg your child is born to an Aussie father, as an Australian or without intention to live/ move back in the near future etc) from which the official is pretty sure that your child is a citizen of a foreign country, then he will not be eligible....well as far as I understood it.

Without doing step 2, how can you do step 3? "Return to Oz"?
In step 3, without giving birth in Oz, how can you get "Oz birth cert"? I believe as long as your are PR, you can apply to add a PR VISA put onto your baby HK passport. Or when you turn Citiezen, your baby will be citizen as well.

Step 4, as long as you are not going decare to give up Chinese Nationality, you can still renew your passport. This only apply to HK people, my friend from mainland china, don't how chinese gov can found out but he didn't inform chinese gov when he return to china for visit, they collected his chinese passport....
by the way, I have my kids HK passport renew in Oz without any problem. Just pay more for the handling fee.

You never able to find out the truth..... because if I am the successful case to get HK passport, I won't tell you my details or how I got it if it broke the rule/law.....

by the way, I am thinking what is the importancy to have HK passport? If I go back hk for holiday, 90 days long enough for me and no visa require anyway.

Only enter to China but where I'm not really interested in. If for kids future, then once you proof that you are going to stay HK, you still able to get back your ID card and when you hve 3 starts then you can apply passport.
