My relative rent out a flat ten years ago. Recently, she says that the tenant is not willing to move out. There is no tenancy agreement sign. She tries to contact the tenant and inform him to move out. But no one answer and leave the message in answer machine......... What can she do now? Any way she can potent her benefit?

無租約真係難攪d。

先自己寄封信俾佢，講明要求佢遷出o既日期，真係唔得，可能就要搵律市出信喇!

回家，並不只因為能遮風避雨、吃飽喝暖；
回家，是因為那裡有愛。

有冇交租? 就算冇租約, 有具體租賃行為都得.

10年即係2004年前租落, 你要收樓要用過渡性通知書

業主須在租賃期屆滿後，在擬終止租約前提早12個月向租客送達過渡性終止通知書；如單位屬分租性質，則業主除了要向租客送達通知書外，亦要在處所大門或主要入口連續3天張貼通知書，讓受影響分租戶得悉有關安排。

yes, the property is under my relative. but you know, she is worrying about the long term stay of tenant is able to take the title.
first, there is no tenancy agreement between them
second, the tenant is not willing to move out (his manner) recently.

Yes, the tenant is paying the rent.

過渡性終止通知書 - what is it meant? i do not really understand

住宅租賃以往獲第 IV部賦予租住權保障。《 2004年業主與租客 (綜合 )(修訂 )條例》於 2004年 7月 9日生效後，已將這項保障撤銷。為了讓此日期前已存在的租賃可配合法例的改變，該修訂條例訂明，這些租賃只可透過互訂協議或「過渡性終止通知書」而終止 .

is that meant my relative needs to give the tenant 12 months notice? if he is not moving out, then, i can move forward. is that correct?

呢個係其中一個方法, 亦可以簽一份新既短期租約(例如一個月)完約就可以叫佢搬之類. 或者相方可以傾一個大家都接受既方案.
