From my understanding, the reason why they want sponsor to give intention to move back to canada and release letter is to make sure you are going to move back to canada with the immigrant. Because you are supposed to support him (you signed an undertaking) so he will not apply for unemployment insurance even if he doesn't have a job.
However, in fact, if the person you sponsor is your husband, there is no need to prove your financial situation. When I applied, I did not have to give any previous tax returns or proof of income. However, I did give to them even they did not request it, hoping it will help speed up the application and approval.
Answer to question 1)
你老公係咪擔保人申請你過去?From what I understand,如果係申請配偶,擔保人係無需要提出收入來源!I just checked the sponsor guideline and under "Sponsorship eligibility" it saids:
"In order to sponsor, you must…
.....
prove that you have sufficient income to provide basic requirements for your spouse or common-law partner’s dependent children. To do this, you must provide documents showing your financial resources for the past 12 months.
This requirement applies only when dependent children who have dependent children of their own are included on the application."
不過如果有就可能會好D,證明你唔會過去拿綜援。我老公之前都係大陸做野,又係無稅單 (不過老公係申請人)。
你地(both sponsor and applicant) 有乜野就俾佢睇(有殺錯無放過!)例如: 公司薪金信/employment letter, bank statements for the past 3 months,investment statements, bank reference letter, HK稅單 for the past 3 yrs,糧單,etc.

Actually, I did not apply/submit 冇欠稅紀錄 directly. Is this a new requirement by immigration now??
When immigration requested for my husband's police check, they also requested for my Letter of Release. I'm not sure if you know what is Letter of Release and how to get it...
You can only get the Letter of Release if you quit your job and you tell HR that you are leaving HK, then HR will hold your last month's salary. Then, you will have to go to tax dept. and calculate your outstanding taxes and pay them. Once you pay them, the tax dept. will issue a Letter of Release to your employer to "release" or give you back the last month's salary. You will get a copy of that Letter of Release to submit to immigration.
So, if you are still working, you still have some outstanding tax not paid. And even if you can get a 冇欠稅紀錄, it doesn't mean you have intention to move back to canada because you are still working in HK and you may not quit !
I struggled whether I should quit and provide the Letter of Release because what if they don't approve my husband?? But it is a risk you must decide to take or not. Because it saids on the request letter, if you can't provide it within x days, they may reject your application. Also, I asked a friend who was in the same case (but about 7 yrs ago), she said she was able to ask immigration agent, and they said normally, if they ask for Letter of Release, it's at the very last step and most likely will not have any problems. So I made decision to quit. I did not want to risk the whole application being rejected because they did not get my Letter of Release.
